La Corte Suprema de la India dict\u00f3 una orden provisional el 18 de febrero, prohibiendo la exhumaci\u00f3n y reubicaci\u00f3n forzosa de los cuerpos de cristianos tribales fallecidos fuera de sus cementerios rurales en Chhattisgarh.<\/p>\n

El tribunal superior, compuesto por los jueces Vikram Nath, Sandeep Mehta y N.V. Anjaria, orden\u00f3 detener de inmediato la exhumaci\u00f3n de cuerpos enterrados en el estado, al tiempo que notificaba al gobierno de Chhattisgarh.<\/p>\n

El tribunal declar\u00f3 que \u201cmientras tanto, no se permitir\u00e1 ninguna otra exhumaci\u00f3n de cuerpos enterrados\u201d.<\/p>\n

La orden de la Corte Suprema sigui\u00f3 a una petici\u00f3n de inter\u00e9s p\u00fablico (PIL) presentada por la Asociaci\u00f3n de Chhattisgarh para la Justicia y la Igualdad, apoyada por pastores, activistas y aldeanos afectados.<\/p>\n

El abogado principal Colin Gonsalves, en representaci\u00f3n de los demandantes, dijo al tribunal que las familias cristianas en las zonas tribales estaban siendo obligadas a exhumar a sus parientes fallecidos de los cementerios de las aldeas y reubicarlos sin su consentimiento.<\/p>\n

Seg\u00fan la PIL, los espacios de entierro compartidos tradicionalmente por los aldeanos estaban siendo restringidos cada vez m\u00e1s por motivos religiosos, y las familias supuestamente eran presionadas para abandonar los ritos funerarios cristianos.<\/p>\n

Gonsalves afirm\u00f3 que estas exhumaciones no son hechos aislados, sino que reflejan una tendencia recurrente en todo Chhattisgarh, particularmente en las zonas tribales.<\/p>\n

Las familias a menudo se ven obligadas a abandonar las costumbres funerarias cristianas y adoptar pr\u00e1cticas hind\u00faes como condici\u00f3n previa para el entierro en sus propias aldeas, se\u00f1al\u00f3 la PIL.<\/p>\n

La petici\u00f3n describi\u00f3 las exhumaciones y reentierros forzosos, realizados a veces a decenas de kil\u00f3metros de distancia, como violaciones de las protecciones bajo los Art\u00edculos 14 y 21 de la Constituci\u00f3n de la India.<\/p>\n

El United Christian Forum (UCF), una organizaci\u00f3n de bienestar cristiano que tambi\u00e9n gestiona una l\u00ednea de ayuda nacional, acogi\u00f3 con satisfacci\u00f3n la orden provisional de la Corte Suprema, describiendo el fallo como un \u201cfaro de esperanza\u201d para las comunidades minoritarias que enfrentan hostilidad por sus derechos de entierro.<\/p>\n

La organizaci\u00f3n expres\u00f3 su esperanza de que \u201clas tumbas cristianas no sean perturbadas nunca m\u00e1s\u201d, tras la intervenci\u00f3n del tribunal.<\/p>\n

El presidente del UCF, Michael Williams, en una declaraci\u00f3n a los medios, dijo que la intervenci\u00f3n de la Corte Suprema marc\u00f3 \u201cun paso vital en la protecci\u00f3n de la dignidad de los muertos y los derechos constitucionales de las minor\u00edas religiosas\u201d.<\/p>\n

El UCF tambi\u00e9n expres\u00f3 su preocupaci\u00f3n por las campa\u00f1as que buscan eliminar a los cristianos tribales del estatus de Tribu Programada en algunos estados de la India, calificando tales esfuerzos de \u201cdiscriminatorios\u201d y advirtiendo que vincular la identidad tribal con la religi\u00f3n corre el riesgo de socavar las protecciones constitucionales.<\/p>\n

El UCF dijo que registr\u00f3 23 incidentes relacionados con entierros en 2025, la mayor\u00eda de ellos en Chhattisgarh, lo que describi\u00f3 como parte de un \u201cpatr\u00f3n de intimidaci\u00f3n y discriminaci\u00f3n\u201d contra los cristianos tribales.<\/p>\n
