Explicit\u00e9 dans le <a href=\"https:\/\/www.vatican.va\/archive\/ENG0015\/_INDEX.HTM\" target=\"null\" class=\"null\" rel=\"noopener noreferrer nofollow\">Cat\u00e9chisme de l'\u00c9glise catholique<\/a> (n\u00b0 1467) et le <a href=\"https:\/\/www.vatican.va\/archive\/cod-iuris-canonici\/cic_index_en.html\" target=\"null\" class=\"null\" rel=\"noopener noreferrer nofollow\">Code de droit canonique<\/a> (n\u00b0 983, 1388), cet enseignement oblige les pr\u00eatres \u00e0 maintenir une confidentialit\u00e9 absolue concernant \u00e0 la fois le contenu des confessions et l'identit\u00e9 des p\u00e9nitents. La violation de cette confidentialit\u00e9 entra\u00eene une excommunication automatique, r\u00e9versible uniquement par le pape.&nbsp;<\/p>\n<p>La confraternit\u00e9 a fait valoir que des lois comme celle de l'\u00c9tat de Washington portent atteinte \u00e0 la libert\u00e9 religieuse tout en ne servant pas la justice, citant le premier amendement de la Constitution am\u00e9ricaine, la loi sur les droits de l'homme de 1998 au Royaume-Uni et la Constitution australienne.&nbsp;<\/p>\n<p>Dans sa d\u00e9claration, le groupe a soulign\u00e9 l'engagement de l'\u00c9glise en faveur de la protection des enfants par le biais d'enqu\u00eates criminelles et de proc\u00e9dures judiciaires, ce qui \u00ab peut \u00eatre fait l\u00e9galement et moralement sans violer la libert\u00e9 religieuse \u00bb.<\/p>\n<p>Notamment, les auteurs de la d\u00e9claration ont \u00e9galement soulign\u00e9 l'absurdit\u00e9 d'exiger des pr\u00eatres qu'ils identifient des p\u00e9nitents anonymes. Ils ont aussi insist\u00e9 sur l'injustice de lois comme celle de l'\u00c9tat de Washington, qui exempte d'autres professionnels, tels que les m\u00e9decins et les th\u00e9rapeutes, de l'obligation de divulgation.&nbsp;<\/p>\n<p>Apr\u00e8s l'adoption du projet de loi 5375 du S\u00e9nat de Washington, promulgu\u00e9 par le gouverneur Bob Ferguson le 3 mai et entr\u00e9 en vigueur le 27 juillet, le minist\u00e8re de la Justice des \u00c9tats-Unis (DOJ) a r\u00e9agi rapidement.&nbsp;<\/p>\n<p>Harmeet Dhillon, procureure g\u00e9n\u00e9rale adjointe de la division des droits civils du DOJ, a envoy\u00e9 une <a href=\"https:\/\/www.catholicnewsagency.com\/storage\/pdf\/dojletter.pdf\" target=\"null\" class=\"null\" rel=\"noopener noreferrer nofollow\">lettre<\/a> \u00e0 Ferguson, un catholique, quelques jours seulement apr\u00e8s qu'il ait sign\u00e9 le projet de loi, annon\u00e7ant une enqu\u00eate sur la loi et la qualifiant d'\u00ab attaque l\u00e9gislative contre l'\u00c9glise catholique et son sacrement de confession, une pratique religieuse ordonn\u00e9e par l'\u00c9glise catholique remontant aux origines de l'\u00c9glise \u00bb.<\/p>\n<p>Le DOJ a ensuite <a href=\"https:\/\/www.catholicnewsagency.com\/news\/264953\/justice-department-sues-washington-state-over-law-forcing-priests-to-break-confession-seal\" target=\"null\" class=\"null\" rel=\"noopener noreferrer nofollow\">a d\u00e9pos\u00e9 une plainte <\/a>contre Washington le 23 juin, affirmant que la loi viole la protection du libre exercice de la religion garantie par le premier amendement. \u00ab Le secret de la confidentialit\u00e9 est\u2026 l'\u00e9l\u00e9ment vital de la confession \u00bb, a d\u00e9clar\u00e9 le DOJ dans son m\u00e9moire. \u00ab Sans lui, le libre exercice de la religion catholique\u2026 ne peut avoir lieu. \u00bb&nbsp;<\/p>\n<p>Les \u00e9v\u00eaques catholiques de Washington, dont l'archev\u00eaque de Seattle Paul Etienne et l'\u00e9v\u00eaque de Spokane Thomas Daly, <a href=\"https:\/\/www.catholicnewsagency.com\/pdfs\/complaint-etienne-v-ferguson.pdf\" target=\"null\" class=\"null\" rel=\"noopener noreferrer nofollow\">ont d\u00e9pos\u00e9 une plainte f\u00e9d\u00e9rale le 29 mai<\/a> contestant la loi sur la base du premier amendement et de l'\u00e9galit\u00e9 de protection.<\/p>\n<p>La plainte a mis en \u00e9vidence les politiques robustes de protection de l'enfance de l'\u00c9glise, qui, selon les \u00e9v\u00eaques, d\u00e9passent les exigences de l'\u00c9tat. \u00ab L'archidioc\u00e8se catholique romain de Seattle et les dioc\u00e8ses de Yakima et de Spokane ont chacun adopt\u00e9 et mis en \u0153uvre\u2026 des politiques qui vont plus loin dans la protection des enfants que les exigences actuelles de la loi de Washington \u00bb, indique la plainte.<\/p>\n<p>Daly a promis aux fid\u00e8les catholiques que le clerg\u00e9 ferait face \u00e0 l'emprisonnement plut\u00f4t que de briser le secret de la confession. \u00ab Je tiens \u00e0 vous assurer que vos bergers, \u00e9v\u00eaques et pr\u00eatres sont d\u00e9termin\u00e9s \u00e0 garder le secret de la confession, m\u00eame au point d'aller en prison \u00bb, a-t-il d\u00e9clar\u00e9.
